Welcome to JULLZ LANDSCAPES LLC. These Terms and Conditions ("Terms") govern the relationship between JULLZ LANDSCAPES LLC ("Company," "we," "us," or "our") and the client ("Client," "you," or "your") regarding the provision of landscaping, design, maintenance, and related services.

1. Scope of Services

The specific services to be performed (the "Work") will be detailed in a separate Estimate, Proposal, or Work Order. Any changes or "scope creep" requested by the Client after the commencement of Work may result in additional charges and require a written Change Order.

2. Estimates and Pricing

  • Validity: Estimates are valid for 30 days from the date of issuance.
  • Variations: We reserve the right to adjust pricing if site conditions differ significantly from what was visible during the initial walkthrough (e.g., hidden underground rock, debris, or utility lines).
  • Taxes: All applicable Texas state and local sales taxes will be added to the final invoice unless a valid tax-exempt certificate is provided.

3. Payment Terms

  • Deposit: A non-refundable deposit (typically 30-50%) is required to secure a start date for larger projects.
  • Progress Payments: For projects lasting longer than two weeks, progress payments may be scheduled.
  • Final Payment: Due immediately upon completion of the Work.
  • Late Fees: Invoices unpaid after 15 days will accrue interest at a rate of 1.5% per month (18% per annum) or the maximum rate permitted by Texas law.

4. Client Responsibilities

To ensure a safe and efficient workflow, the Client agrees to:

  • Access: Provide unobstructed access to the property during service hours.
  • Utilities: Clearly mark any private underground lines (sprinklers, invisible fences, lighting). We are not responsible for damage to unmarked private lines.
  • Pets & Debris: Ensure the work area is free of pets, pet waste, and personal items prior to our arrival.
  • Permits: Unless otherwise agreed, the Client is responsible for obtaining HOA approvals or building permits.

5. Warranties and Limitation of Liability

  • Plants/Sod: While we install healthy plants, we do not guarantee survival once installed, as health depends on Client maintenance (watering/feeding).
  • Hardscapes: We provide a 1-year warranty on the structural integrity of hardscape installations against workmanship defects.
  • Liability: Our liability shall not exceed the total amount paid by the Client for the specific service in question.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this agreement shall be resolved in the courts of Dallas County, Texas.
